Privacy policy

Health Super Pty Ltd (“the Trustee”, “we” or “us”) is the trustee of the Health Super Fund ("the Fund"). The Trustee complies with the Privacy Act 1988, incorporating the ten National Privacy Principles (“NPPs”), which regulates the collection, holding, use, correction and disclosure of “personal information” by private sector organisations. "Personal information" is information about an individual, which can identify the individual, and includes "sensitive information" which is information about a person’s health, politics, sexual preference and other matters.

The Trustee must also comply with the Victorian Health Records Act 2001 ("the Health Records Act"), incorporating the nine "Health Privacy Principles" (“HPPs”), as it holds health information records in Victoria.

This Privacy Policy and Health Information Management Statement is provided for members, potential members and beneficiaries of the Fund.

Why we collect your personal information

We only collect personal information that is necessary for our functions as trustee and administrator of the Fund.

Our primary purposes for collecting your personal information, are to:

  • establish you as a member
  • assist your employer in meeting its obligations
  • manage your superannuation (including assist you to find lost or inactive superannuation accounts with other superannuation arrangements so that you receive all your superannuation benefits when you retire)
  • provide information to you about superannuation, insurance and your entitlements (including general educational material to promote financial literacy, retirement savings and protection against life risks)
  • provide information about products and discounts available through the member privileges program
  • pay and/or transfer your superannuation
  • enable related organisations of the Trustee (e.g. Health Super Financial Planning) to assist you with financial services including advice about products other than superannuation
  • assess your eligibility for and arrange insurance cover; assess the entitlement of, and pay a death benefit (including any insured component) to, your dependants or your estate
  • assess the entitlement of, and pay a disability benefit (including any insured component) to which you may become entitled
  • provide and improve our website and other services to you.

We, or Health Super Financial Planning, may also use this information to provide members with marketing material about products or services available under the member privileges program, retirement seminars and investment seminars that are directly related to superannuation or retirement planning.

Collecting sensitive health information

Sensitive health information about a member is collected directly from the member where it is reasonable or practicable to do so. When we collect sensitive health information about you, we will provide details about how that information may be used or disclosed. We may also collect sensitive health information from third parties in the course of handling a legal or equitable claim.

When we disclose your personal information

We generally disclose information to third parties which assist us in the operation of the Fund if we have a contract or agreement with them. For example, disclosure may be made to: insurers, underwriters, medical advisors, professional advisors, auditors, actuaries, mail houses, information technology providers and associated companies of Health Super.
We also disclose information to third parties where necessary to perform our functions as trustee and administrator of the Fund, for example, your employer or other superannuation funds.

We may disclose information to the Australian Taxation Office (ATO) for the purpose of searching the Lost Member Register so that we can assist you with finding any lost or inactive superannuation accounts. We may also be required to disclose members' personal information where required or authorised by taxation, superannuation, corporations or anti-money laundering laws to Regulators including the ATO, ASIC, APRA and AUSTRAC, other government agencies or other persons.

We will only disclose your sensitive health information with your consent.

Data Quality

We need to keep our records up-to-date in order to provide you with information about your superannuation and ultimately to pay you your benefits. If we don’t have a record of your correct tax file number, you may be paying more tax than you need to. For these reasons we may contact you requesting that you update us on your current details.

Security

To protect your personal information from unauthorised access, modification or disclosure we maintain security measures in handling your personal information. These include:

  • asking you to answer identifying questions before discussing your superannuation benefits on the phone
  • only providing information to third parties purporting to act on your behalf after receiving an original signed consent form or a certified copy of a court or tribunal order
  • providing only a limited amount of personal information by email
  • strictly controlling and monitoring personal information stored in documents (as a hard copy), as electronic data or in software on our systems to ensure data integrity
  • archiving or secure destruction of non-current information in both electronic form and hard copy
  • annual Internal and External Audit review of security and annual compliance audit of data integrity measures.

Openness, Access and Corrections

This Privacy Policy is made available to any person on request and is available on our website.

We generally allow you to access, verify and correct the personal information we hold about you. However the NPPs and HPPs entitle us to refuse access in particular circumstances. If we do refuse you access, we will normally give you our reasons for doing so.

Requests for access will generally be acknowledged within 7 days and responded to in writing within 14 days. However, this may take a longer time if members request access to sensitive, health information. The Trustee will not charge members for reasonable access to personal information.

There is a form on our website for updating your personal information, however if you wish to do this by telephone, we are required to verify your identity before making any changes.

More Information and Complaints

Health Super’s Privacy Officer handles enquiries and complaints about its privacy practices. Please contact the Privacy Officer if you are concerned that we have interfered with your privacy.

If you are not satisfied with our response to your complaint, you may contact the Privacy Commissioner or, if it relates to health information, the Victorian Health Services Commissioner.
